¿Quién presenta la candidatura?
Municipal eLibrary es una práctica de más de 10 años, que busca ayudar a que los profesionales del gobierno local y regional de todo el mundo compartan conocimientos a través de participar e informar sobre libros, informes, estudios y otros documentos, que tienen que ver con la realidad local y regional; además de detallar sobre acontecimientos relevantes vinculados con el gobierno local, la descentralización y el desarrollo del territorio. Para ello mantiene una página web, un canal de Youtube, una cuenta de Twitter y un grupo en Facebook.
En el espíritu de total transparencia (full disclosure), debo informar que Nestor Vega, fundador de Municipal eLibrary, es Intendente de Información Territorial de la Superintendencia de Ordenamiento Territorial, Uso y Gestión del Suelo.
¿En qué consiste la experiencia?
La práctica presentada es la creación de la Superintendencia de Ordenamiento Territorial, Uso y Gestión del Suelo (www.SOT.gob.ec) en Ecuador. Esta enmarca su gestión en el ejercicio de los derechos del Buen Vivir establecidos en la Constitución vigente.
Con la SOT, los ecuatorianos y ecuatorianas cuentan con una entidad técnica que vigila y controla los procesos de ordenamiento territorial, uso y gestión de suelo, hábitat, asentamientos humanos y desarrollo urbano.
La gestión de la Superintendencia aporta al ejercicio de los Derechos del Buen Vivir en lo relacionado con los derechos a la ciudad y el territorio, a fin de contribuir a que la ciudadanía disponga de las mismas posibilidades de acceso a un hábitat seguro y saludable; a una vivienda adecuada y digna; a la función social y ambiental de la propiedad en todas sus formas y a la participación ciudadana, precautelando el manejo eficiente y racional de los recursos para garantizar la calidad de vida digna de las presentes y futuras generaciones.
Este trabajo de vigilancia y control se realiza de manera coordinada, articulada y en cooperación con las municipalidades –en el Ecuador, Gobiernos Autónomos Descentralizados (GAD)– respetando la autonomía y reforzando la rectoría que tienen estas instancias en las circunscripciones que gobiernan.
Siguiendo los lineamientos de la Ley, la Superintendencia de Ordenamiento Territorial, Uso y Gestión del Suelo tiene, entre otros, dos objetivos que se refieren al tema:
- Vigilar que el conjunto de derechos de las personas, colectivos y pueblos se respeten dentro de los ámbitos del ordenamiento territorial a cargo de todos los niveles de gobierno, y del uso y gestión del suelo, hábitat, asentamientos humanos y desarrollo urbano, por los GAD municipales y metropolitanos.
- Vigilar y controlar el cumplimiento de las normas y acuerdos internacionales, la constitución, las leyes, las normas locales como ordenanzas provinciales y cantonales, en materia de ordenamiento territorial, planeamiento urbanístico, uso y gestión de suelo.
¿Por qué es una práctica innovadora?
El Derecho a la Ciudad y el Derecho de la Naturaleza son derechos constitucionales en el Ecuador desde el 2008. Cabe anotar que el Ecuador es el único país del mundo que reconoce estos derechos en su Constitución. Lo anterior significa que para el 2016 en que se creó la Superintendencia por ley, se partía ya de una importante innovación.
Ahora bien, la Superintendencia como órgano que vigila el cumplimiento del derecho a la ciudad y el territorio, en lo referente al ordenamiento territorial, es única en el mundo. Es una notable respuesta de un estado que pretende precautelar los derechos a la ciudad y al territorio, sin alterar el principio de autonomía de los gobiernos locales.
Esto significa que es único el lugar en el mundo en el que la ciudadanía puede reclamar el cumplimiento de sus derechos a la ciudad y el territorio por parte de municipios, gobiernos intermedios y el gobierno nacional.

Who’s presenting the candidacy?
Municipal eLibrary is a practice of more than 10 years, which seeks to help local and regional government professionals from around the world share knowledge through participating and reporting on books, reports, studies and other documents, which have to do with the local and regional reality; in addition to relevant events linked to local government, decentralization and the development of the territory. For this purpose, it maintains a web page, a YouTube channel, a Twitter account and a Facebook group.
In the spirit of full disclosure, we must inform that Nestor Vega, founder of Municipal eLibrary, is the Intendant of Territorial Information of the Superintendence of Territorial Planning, Land Use and Land Management.
What’s the experience about?
The practice presented is the creation of the Superintendence of Territorial Planning, Land Use and Land Management (www.SOT.gob.ec) in Ecuador. The superintendence frames its work in the exercise of the Rights of Well-being (Buen Vivir) established in the Ecuadorian Constitution.
With the SOT, Ecuadorians have a technical entity that monitors and controls the processes of territorial planning, land use and land management, habitat, human settlements and urban development.
The work of the Superintendence contributes to the exercise of the Rights of Well-being related to the rights to the city and the territory, by contributing to citizen’s equal opportunities to access to a safe and healthy habitat; to adequate and dignified housing; to the social and environmental functions of property, in all its forms; and, to citizen participation. All of this, while protecting the efficient and rational management of resources, guaranteeing a high quality of life worthy of present and future generations.
This monitoring and control work is carried out in a coordinated and articulated manner, and in cooperation with the municipalities -in Ecuador, Decentralized Autonomous Governments (GAD)-, respecting their autonomy and reinforcing the rectory that these administrations have in the circumscriptions that they govern.
Following the guidelines of the Law, the Superintendence of Territorial Planning, Land Use and Land Management has, among others, two objectives that refer to the subject:
- Ensure that the set of rights of individuals, groups and peoples are respected within the areas of territorial planning by all levels of government, and that the land use and land management, habitat, human settlements and urban development are respected by the municipal and metropolitan GADs.
- Monitor and control the compliance with norms and international agreements, the constitution, the laws, local regulations such as provincial and cantonal ordinances, regarding land use planning, urban planning, land use and land management.
Why is it innovative?
The Right to the City and the Right to Nature are constitutional rights in Ecuador since 2008. It should be noted that Ecuador is the only country in the world that recognizes these rights in its Constitution. The foregoing means that for 2016, in which the Superintendence was created by law, it was already starting from an important innovation.
Presently, the Superintendence as the organization that monitors the compliance with the Right to the City and the Territory, regarding territorial planning, is unique in the world. It is a noteworthy response of a State that seeks to protect the Rights to the City and the Territory, without altering the principle of local autonomy.
All of this means that it is unique example in the world, where citizens can claim the fulfilment of their Rights to the City and to the Territory from municipalities, intermediate governments and the national government.

Municipal eLibrary est une pratique de plus de 10 ans, qui vise à aider les professionnels des gouvernements locaux et régionaux du monde entier, pour qu’ils puissent partager leurs connaissances en participant et en rendant compte sur les livres, rapports, études et d’autres documents relatifs à la réalité de la région et la collectivité locale ; en plus de détailler les événements pertinents liés à l'administration locale, la décentralisation et le développement du territoire. Pour cela, il maintient une page Web, une chaîne YouTube, un compte Twitter et un groupe Facebook.
Dans l'esprit d’une transparence totale, je dois informer que Nestor Vega, fondateur de Municipal eLibrary, est l'Intendant de l'Information Territoriale de la Surintendance de l'Aménagement du Territoire, de l’Utilisation et de la Gestion des Terres.
Quelle est l'expérience?
La pratique présentée est la création de la Surintendance de l'Aménagement du Territoire, de l’Utilisation et de la Gestion des Terres (www.SOT.gob.ec) en Équateur. Celle-ci encadre sa gestion dans l'exercice des Droits du bien-être (Buen Vivir) établis dans la Constitution en vigueur en Equateur.
Avec le SOT, les équatoriens comptent sur une entité technique qui contrôle et surveille les processus d'aménagement du territoire, l'utilisation et la gestion des terres, l'habitat, les établissements humains et le développement urbain.
La gestion de la Surintendance contribue à l'exercice des droits du Bien-être relatifs aux droits de la ville et du territoire, en contribuant à l'égalité des possibilités des citoyens d'accéder à un habitat sûr et sain; à un logement adéquat et digne; aux fonctions sociales et environnementales de la propriété, sous toutes ses formes; et, à la participation des citoyens. Tout cela, en protégeant la gestion efficace et rationnelle des ressources, en assurant une qualité de vie digne pour les générations actuelles et futures.
Ce travail de surveillance et contrôle est effectué d'une manière coordonnée et articulée, et en coopération avec les municipalités -dans l'Équateur, les Gouvernements Autonomes Décentralisés (GAD) - en respectant leur autonomie et le renforcer du rectorat qui possèdent ces instances dans les circonscriptions qu'ils gouvernent.
D'après les directives de la loi, la Surintendance de l'Aménagement du Territoire, de l’Utilisation et de la Gestion des Terres a, entre autres, deux objectifs qui se réfèrent au sujet:
- Veiller à ce que l'ensemble des droits des individus, des groupes et des peuples soit respecté dans les domaines de la planification territoriale par tous les niveaux de gouvernement; ainsi que l'utilisation et la gestion des terres, l'habitat, les établissements humains et le développement urbain, par les GAD municipaux et métropolitains.
- Surveiller et contrôler le respect des normes et des accords internationaux, la constitution, les lois, les règlements locaux tels que cantonaux et provinciaux, en ce qui concerne les ordonnances de planification du territoire, l'urbanisme, l'aménagement du territoire et la gestion des terres.
Pourquoi vous considérez que c’est une pratique innovante?
Le Droit à la Ville et le Droit à la nature en Equateur sont des droits constitutionnels depuis 2008. C'est important noter que l'Equateur est le seul pays dans le monde qui reconnaît ces droits dans la Constitution. Ce qui précède signifie que pour 2016, lorsque la Surintendance a été créée par la loi, elle commençait déjà à partir d'une innovation importante.
Actuellement, la Surintendance en tant qu'organisation qui surveille le respect du droit à la ville et au territoire, par rapport à l'ordre territoriale, est unique dans le monde. C'est une réponse remarquable à un État qui cherche à protéger les droits de la ville et du territoire, sans modifier le principe de l'autonomie locale.
Cela signifie qu'il est le seul endroit au monde, où les citoyens peuvent revendiquer le respect de leurs droits à la ville et au territoire de la part des municipalités, des gouvernements intermédiaires et du gouvernement national.
